Adjudication is an increasingly used form of dispute resolution within the construction industry.
The main changes relate to the payment terms and payment related notices. The amendments relating to Adjudication do not require any changes to the contract because the JCT suite of contracts refer to the Act itself and the Scheme for Construction Contracts as the rules for Adjudication. The amendments include extensive changes to the payment certificates, applications and notices subsections with less significant changes to the rules for termination. There are other minor amendments to the JCT suite of contracts. In this article for the most part we are referring to the Standard Building Contract.
This Practice Note looks at the need for legislation in the construction industry, the application of the HGCRA , the Scheme for Construction Contracts and a brief overview of the payment provisions and the process for determining a dispute by way of adjudication. This Practice Note considers when the Housing Grants, Construction and Regeneration Act HGCRA applies, including the meaning of construction contract and the meaning of construction operations and the issue of hybrid contracts. The HGCRA was a legislative response to the perceived cash flow problems and dispute culture within the construction industry during the s and s that were highlighted by the Latham Report, 'Constructing the Team'.
